Terms of Service

The agreement between you and Qurio when you use the app.

1. Introduction and Acceptance

These Terms of Service (the "Terms") form a legally binding agreement between you, the parent or legal guardian who creates an account, and Dhammachintak Neel and Ashutosh Vikram, individuals jointly operating the Qurio application, with a correspondence address at A106, Ushodaya Aqua, Hosa Road, Choodasandra, Bengaluru, Karnataka — 560035, India ("Qurio", "we", "us", or "our"), governing your and your child's use of the Qurio mobile application and any related services we provide (collectively, the "Service").

The Service is distributed through the Apple App Store and Google Play Store.

Please read these Terms carefully. By creating a Parent account, ticking the "I agree" box, or allowing your child to use Qurio, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.

If you do not agree to these Terms, do not create an account, do not allow your child to use Qurio, and uninstall the app.

2. Eligibility, Parental Acceptance, and Responsibility

2.1 Who Qurio Is For

Qurio is an AI-powered curiosity and learning companion designed for children aged 7 to 12. The in-app experience is intended for children in this age range.

2.2 Who Must Accept These Terms

These Terms must be read, understood, and agreed to by a parent or legal guardian who is at least 18 years of age and has the legal capacity to enter into a binding contract under Indian law (the "Parent"), acting on behalf of the child or children who will use Qurio (each, a "Child").

By accepting these Terms, you represent and warrant that:

A child cannot accept these Terms. If you are under 18, please do not use Qurio unless your parent or legal guardian has set up the account and accepted these Terms on your behalf.

2.3 Parental Responsibility

You acknowledge and agree that, as the Parent:

You agree that Qurio is a tool to support, not replace, the supervision, judgment, and care of a parent or guardian.

3. The Service

3.1 What Qurio Does

Qurio is an educational exploration tool that uses generative artificial intelligence to answer questions from children in an age-appropriate way. Core features include text and voice question-asking, AI-generated answers, follow-up question suggestions, age-appropriate visuals retrieved from open-licence sources, a Parent Dashboard, and automated safety features.

3.2 What Qurio Is Not

Qurio is not:

To use Qurio, the Parent must:

  1. create a Parent account by providing an email address and verifying a phone number via one-time password (OTP);
  2. accept these Terms and the Privacy Policy and provide the consents required under applicable law, including India's Digital Personal Data Protection Act, 2023;
  3. create one or more Child profiles by providing the Child's first name and age; and
  4. configure any topic restrictions, time limits, or notification preferences as appropriate.

The Service may not be used until these steps are completed.

3.4 Changes to the Service

We are continuously improving Qurio. We reserve the right, at our sole discretion, to add, modify, suspend, or discontinue any feature of the Service, in whole or in part, at any time, with or without notice. We are not liable to you or to any third party for any modification, suspension, or discontinuation of the Service.

4. Artificial Intelligence and Educational Disclaimer

This Section 4 is critical. Please read it carefully.

4.1 Qurio Uses Generative AI

Qurio's responses are generated by third-party large language models, including Anthropic's Claude, and are processed through additional automated safety systems. Generative AI is a probabilistic technology — it predicts likely text based on patterns in its training data. It does not "know" facts the way a teacher or a textbook does.

4.2 AI Can Make Mistakes

Despite the extensive safety guardrails, content-moderation checks, and age-band controls we have built into Qurio, you acknowledge and accept that the Service:

Qurio is designed to spark curiosity and support learning through exploration, not to provide authoritative or definitive answers. You agree that:

You are solely responsible for any decision you, your Child, or any third party takes based on content generated by Qurio. We are not liable for any consequence of such reliance.

5. Safety Features and the Limits of Automated Safety

This Section 5 is critical. Please read it carefully.

5.1 What Our Safety Features Do

Qurio includes a suite of automated safety features, including:

5.2 Best-Effort, Automated, and Imperfect

You acknowledge and expressly agree that these safety features are automated, best-effort, and inherently imperfect. Specifically:

5.3 Not a Medical, Psychological, or Emergency Service

Qurio is not a medical device. It is not a mental-health service. It is not a counselling service. It is not an emergency service. It is not a child-safety monitoring service.

If your Child is in immediate physical danger, is experiencing a medical or mental-health emergency, or appears to be at risk of harming themselves or others, you must immediately contact qualified professionals and emergency services.

In India, this includes:

You must consult licensed medical professionals, mental-health professionals, and other qualified experts for any concern about your Child's physical or mental health. You agree not to rely on Qurio, or on the absence of a Crisis Detection alert from Qurio, as any indication that your Child is safe or well.

5.4 You Remain Responsible for Your Child's Safety

By using the Service, you expressly acknowledge that the physical, mental, emotional, and psychological safety of your Child remains at all times your responsibility, and not ours. The existence of our safety features does not transfer any portion of that responsibility to us.

6. Acceptable Use Policy and Prohibited Conduct

6.1 Your Licence

Subject to your compliance with these Terms, we grant you and your Child a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the Qurio app on a personal mobile device for the personal, non-commercial use of you and your Child. This licence terminates automatically if you breach these Terms.

6.2 Prohibited Conduct

You agree that you will not, and you will not permit your Child or any third party to:

(a) Misuse or attack the Service:

6.3 Enforcement

We reserve the right, at our sole discretion and without prior notice, to:

Suspension or termination under this Section 6 is in addition to, and not in lieu of, any other remedy available to us under these Terms or applicable law. We are not obligated to refund any fees (where applicable) in the event of suspension or termination for breach.

7. Fees and Paid Features

The Service is currently provided free of charge in India. We reserve the right to introduce paid features, subscriptions, or in-app purchases in the future. Any paid feature will be offered subject to additional terms that will be presented before purchase, and any in-app purchase available to a Child will be gated behind a Parental Gate (a verifiable parental authentication step), consistent with the requirements of the Apple App Store and Google Play Store.

You agree that nothing in these Terms or in the Service entitles you to any refund, credit, or compensation for any free feature that we modify, restrict, or remove.

8. Third-Party Services and Platforms

8.1 Distribution Platforms

You obtain Qurio through the Apple App Store or the Google Play Store. These platforms have their own terms of service that govern your download and use of the app on their respective devices, in addition to these Terms. In the event of conflict between these Terms and the relevant platform terms, the platform terms will prevail to the extent required by that platform.

If you downloaded Qurio from the Apple App Store, you acknowledge that:

Google Play Store Additional Terms

If you downloaded Qurio from the Google Play Store, your use is also subject to the Google Play Terms of Service and the Google Play Families Policy.

8.2 Third-Party Service Providers

Qurio relies on third-party service providers to deliver the Service, including (without limitation) Anthropic, OpenAI (Moderation API only), Google Cloud Platform, Firebase, Gupshup, SendGrid, and PostHog. Your use of the Service is subject to those providers' applicable terms with respect to data processing as described in our Privacy Policy. We are not responsible for the acts, omissions, availability, or content of any third-party service.

9. Intellectual Property

9.1 Our Intellectual Property

The Service, including the Qurio app, brand, name, logo, design, user interface, text, graphics, images, illustrations, video, audio, code, system prompts, topic cards, and all other content (other than User Content as defined below), is the property of Dhammachintak Neel and Ashutosh Vikram (jointly operating Qurio) or our licensors and is protected by Indian and international copyright, trademark, and other intellectual-property laws.

Except for the limited licence granted to you in Section 6.1, these Terms do not grant you any right, title, or interest in or to the Service or any of our intellectual property.

9.2 User Content

"User Content" means the questions, voice inputs, settings, preferences, and other content that you or your Child submit to the Service.

You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, transmit, process, display, and otherwise use your User Content solely for the purposes of operating, maintaining, securing, and improving the Service (including for safety review and the limited internal purposes described in the Privacy Policy). We do not use Child voice inputs or Child text inputs to train foundation AI models.

9.3 AI-Generated Output

Output generated by the Service in response to your Child's inputs is made available to you for your personal, non-commercial use within the Service. Given the nature of generative AI, identical or similar outputs may be generated for other users, and we do not claim exclusivity over any particular AI output. You may not represent AI-generated output as authoritative fact, and you may not use AI output in any manner inconsistent with Section 6.

9.4 Feedback

If you send us feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use that feedback for any purpose, without compensation or attribution to you.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect personal data, including the special protections that apply to Children's data under the Digital Personal Data Protection Act, 2023, the Apple App Store Kids Category requirements, the Google Play Families Policy, and the principles of COPPA. Please review the Privacy Policy carefully.

11. Suspension, Termination, and Data Deletion

11.1 Termination by You

You may stop using the Service at any time. You may delete your Child's data or your entire account at any time from the Parent Dashboard or by writing to privacy@qurioapp.com, in which case we will hard-delete personal data as described in the Privacy Policy.

11.2 Termination by Us

We may suspend or terminate your access to the Service, with or without notice, if:

On termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination — including Sections 4 (AI Disclaimer), 5 (Safety Disclaimer), 9 (Intellectual Property), 12 (Disclaimer of Warranties), 13 (Limitation of Liability), 14 (Indemnification), 15 (Governing Law and Jurisdiction), and 17 (Miscellaneous) — will survive.

12. Disclaimer of Warranties

To the maximum extent permitted by applicable law:

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranty of any kind.

We expressly disclaim all warranties, conditions, and representations of any kind, whether express, implied, statutory, or otherwise, including but not limited to any implied warranty of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, non-infringement, quiet enjoyment, or arising from course of dealing or usage of trade.

Without limiting the foregoing, we do not warrant that:

You assume all risk arising from your and your Child's use of the Service. No advice or information, whether oral or written, obtained by you from us or through the Service will create any warranty not expressly stated in these Terms.

Some jurisdictions do not allow the exclusion of certain warranties. To the extent any such exclusion is not permitted under applicable law, the disclaimers in this Section apply to the maximum extent permitted.

13. Limitation of Liability

This Section 13 is critical. Please read it carefully.

To the maximum extent permitted by applicable law:

13.1 Exclusion of Indirect Damages

In no event will we, or any of our affiliates, licensors, service providers, agents, or representatives, be liable to you, your Child, or any third party for any:

in each case whether arising under contract, tort (including negligence), strict liability, breach of statutory duty, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

13.2 Aggregate Liability Cap

To the maximum extent permitted by applicable law, our total aggregate liability to you and your Child for all claims arising out of or relating to these Terms or the Service, in the aggregate over any period, will not exceed the greater of:

(a) the total amount you have actually paid to us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim (which, where the Service has been provided free of charge, is zero); and

(b) one thousand Indian rupees (₹1,000).

This cap applies regardless of the form of action and even if any limited remedy in these Terms fails of its essential purpose.

13.3 Carve-Outs

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Indian law, including liability for:

You acknowledge that the disclaimers in Sections 4, 5, and 12 and the limitations in this Section 13 are a fundamental basis of our agreement and reflect a fair allocation of risk between us, particularly in light of the fact that the Service is provided free of charge by an individual developer. Without these provisions, we would not be able to provide the Service on the terms offered.

14. Indemnification

You agree, to the maximum extent permitted by applicable law, to defend, indemnify, and hold harmless Dhammachintak Neel and Ashutosh Vikram (jointly operating Qurio) and our affiliates, licensors, service providers, agents, and representatives from and against any and all claims, demands, actions, proceedings, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defence of that claim. You agree not to settle any such matter without our prior written consent.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms or their subject matter, are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles.

15.2 Exclusive Jurisdiction

You and we agree that the courts located in Bengaluru, Karnataka, India will have exclusive jurisdiction to settle any such dispute or claim, and you irrevocably submit to the jurisdiction of those courts. Nothing in this Section restricts our right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property, confidential information, or to enforce these Terms.

15.3 Statutory Consumer Rights

Nothing in this Section 15 affects any non-waivable right you may have to bring proceedings before, or seek redress from, the consumer dispute redressal commissions established under the Consumer Protection Act, 2019, or any other forum where such right cannot be excluded by contract.

15.4 Informal Resolution First

Before initiating any formal proceeding, you agree to first contact us at hello@qurioapp.com and attempt to resolve the dispute informally and in good faith for at least thirty (30) days. Most concerns can be resolved this way.

16. Changes to These Terms

We may modify these Terms from time to time, for example to reflect new features, changes in law, or changes in our practices. When we make material changes, we will update the "Last Updated" date at the top of these Terms and, where appropriate, notify you by email and/or via an in-app notice.

If you do not agree to the modified Terms, you must stop using the Service and may delete your account. Your continued use of the Service after the modified Terms become effective constitutes your acceptance of the modified Terms.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with the Privacy Policy and any additional terms that we present at the time you access a specific feature, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

17.2 Severability

If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in full force and effect.

17.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms or any rights or obligations under them, in whole or in part, without our prior written consent. We may assign or transfer these Terms, in whole or in part, to any successor in interest or affiliate, or in connection with a sale, merger, reorganisation, or similar transaction, on notice to you.

17.5 No Agency

Nothing in these Terms creates any partnership, joint venture, agency, employment, or fiduciary relationship between you and us.

17.6 Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms to the extent caused by events beyond our reasonable control, including natural disasters, acts of war or terrorism, pandemic, governmental action, internet or telecommunications failures, or failures of third-party service providers.

17.7 Notices

We may give you notice by email, by in-app notification, or by posting a notice within the Service. You may give us notice by writing to hello@qurioapp.com or to A106, Ushodaya Aqua, Hosa Road, Choodasandra, Bengaluru, Karnataka — 560035, India.

17.8 Headings

Headings in these Terms are for convenience only and do not affect interpretation.

17.9 Language

These Terms are drafted in English. Any translation is provided for convenience only, and the English version will prevail in the event of inconsistency.

In compliance with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000 and the rules thereunder, we have designated a Grievance Officer for concerns about the Service and the handling of personal data:
